Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

Pistachio is a family organization app that provides shared lists, chores, notes, daily planning, AI-assisted capture, and related features.

3. User Accounts

• You must provide a valid email address to create an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to use the App
• One person may not maintain more than one account

4. User Content

You retain ownership of all content you create in the App (notes, tasks, etc.). By using the App, you grant us a limited license to store and process your content solely for the purpose of providing the service.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the App, except as permitted by law
• Upload malicious content or interfere with other users

6. Subscriptions and Billing

Pistachio offers optional paid subscriptions (for example, “Pistachio Pro”) with auto-renewing monthly and yearly plans. If you purchase a subscription:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current billing period.
• Your account is charged for renewal within 24 hours prior to the end of the current period at the rate shown at purchase.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
• You can manage or cancel subscriptions in your device settings: Settings → Apple ID → Subscriptions.
• Pricing may vary by region and is displayed in the App before you confirm purchase.
• Refund requests for purchases made through Apple are handled by Apple in accordance with Apple's policies.

7. Account Deletion

You can delete your account at any time from the Settings screen in the App. Upon deletion, your data (notes, tasks, and contacts) will be permanently removed from our servers, subject to reasonable backup retention periods.

8. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided “as is” and “as available” without warranty of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, Buildday LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including loss of data, revenue, or profits. Nothing in these Terms limits liability where such limitation is not permitted by applicable law.

10. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes through the App or by email. Continued use of the App after changes become effective constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Texas and the United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence apply.

13. Apple App Store Licensed Application Terms

If you downloaded the App from the Apple App Store, these Terms serve as the Custom End User License Agreement (“Custom EULA”) between you and Buildday for Pistachio. Apple also publishes a Standard Licensed Application End User License Agreement for apps that do not provide a custom EULA. For Pistachio, this document is your EULA with Buildday. The following terms apply in addition to the rest of this agreement and include the minimum terms Apple requires for custom EULAs:

13.1 Acknowledgement

You and Buildday acknowledge that this EULA is concluded between you and Buildday only, and not with Apple Inc. (“Apple”). Buildday, not Apple, is solely responsible for the App and its content. This EULA may not conflict with the Apple Media Services Terms and Conditions or Usage Rules in effect when you use the App.

13.2 Scope of License

Buildday grants you a limited, non-transferable, non-exclusive license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The App may also be accessed and used by other accounts associated with the purchaser through Apple Family Sharing or volume purchasing, where applicable.

13.3 Maintenance and Support

Buildday is solely responsible for providing maintenance and support services for the App, as described in these Terms or as required by applicable law. You and Buildday acknowledge that Apple has no obligation to provide maintenance or support services for the App.

13.4 Warranty

Buildday is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price paid for the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to warranty failure are Buildday's sole responsibility.

13.5 Product Claims

You and Buildday acknowledge that Buildday, not Apple, is responsible for addressing any claims relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy, or similar laws. Nothing in these Terms limits Buildday's liability to you beyond what applicable law permits.

13.6 Intellectual Property Rights

You and Buildday acknowledge that, in the event of any third-party claim that the App or your use of it infringes that third party's intellectual property rights, Buildday, not Apple, is solely responsible for investigating, defending, settling, and discharging such claim.

13.7 Legal Compliance

You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

13.9 Third-Party Terms

When using the App, you must comply with applicable third-party terms and agreements. For example, if you use voice calling, speech capture, or other network features, you must not violate your wireless data service or carrier agreement.

13.10 Third-Party Beneficiary

You and Buildday acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
